National Court

Summary: The New York Supreme Court determined that, due to inadequate resources, New York City public schools were not providing a “sound basic education” and that New York State violated the Constitution by failing to provide adequate resources to accomplish such. The Court ordered New York State to ascertain the actual cost of providing a sound basic education in districts around the State, entailing the State to: [1] ensure that every school district has the resources necessary for providing long-term planning by schools and school districts; [2] take into account variations in local costs; [3] provide sustained and stable funding in order to promote long-term planning by schools and school districts; [4] provide as much transparency as possible so that the public may understand how the State distributes school aid and ensure a system of accountability to measure whether the reforms implemented by the Legislature actually provide the opportunity for a sound basic education; and [5] remedy the disparate impact of the current finance system.
