Summary: Examines case study demonstrating that the obligation to use MAR to progressively realize ESC rights implies a government duty to do its utmost, within the funding available to it, to ensure that the plans, programs and projects it intends to implement are those most likely to realize people’s rights. Residents of chronically damp and cold social housing facilities in a neglected region of Northern Ireland had requested superior heating systems. The Northern Ireland Housing Executive, the state entity that manages the facilities, ignored their requests but approved a far more costly cladding project that would preserve the building's exterior, but would not address residents' concerns. To realize the right to habitability and affordability of social housing, is not enough for government to spend money on housing--it must choose projects and designs that are most likely to have the effect of realizing people’s rights.
